User understands that Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., may advertise this web site on numerous publications, websites, search engines and any other advertisement source we deem necessary.
- User understands that both Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., and Cyber Real Estate Inc. are not a Licensed Real Estate Brokerage and is not creating an agency relationship nor will be representing your property in any way.
- The services and any content information offered by Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., and Cyber Real Estate Inc. to Users ARE PROVIDED SOLELY FOR GENERAL INFORMATION, AND DOES NOT CONSTITUTE REAL ESTATE, LEGAL, TAX, ACCOUNTING, OR OTHER PROFESSIONAL ADVICE. BEFORE ACTING ON ANY INFORMATION PROVIDED BY CYBER PROPERTY EXCHANGE (CPREX.COM), A DIVISION OF CYBER REAL ESTATE INC., or CYBER REAL ESTATE INC., USER SHOULD CONSULT WITH AN APPROPRIATE PROFESSIONAL.
- User agrees to indemnify and hold harmless Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., and Cyber Real Estate Inc. any misrepresentation, nondisclosure or concealment of any content and/or information obtained through the services and/or any content offered by Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., and/or Cyber Real Estate Inc.
- Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., and Cyber Real Estate Inc. shall not be responsible or liable for any loss or damage, of any sort incurred as the result of any such dealings, property transaction and including but not limited to cooperating brokers in compensation or commission disputes or as the result of the presence of partners, advertisers, affiliates or sponsors on or through the services offered directly or indirectly by Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc. and/or Cyber Real Estate Inc.
- User certifies that they are the owner of said property, or the owner of said property has given them permission to advertise their property, and that the owner of said property has full legal rights to transfer ownership to another party. The User (a) represents and warrants that all Properties and associated information provided by the User will be accurate; (b) agrees that the User will not permit the posting of a property on the Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., system under only either that they are the owner of said property or the named licensed real estate agents that have been engaged by the property owner to market the property under the terms of a duly executed listing agreement with the property owner; (c) User agrees to administer the Properties provided by the User and maintain their accuracy at all times including, but not limited to as to the status of the property and it's availability for sale, including any pending sales or sale of said property. Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., reserves, in a manner consistent with reasonable commercial business practices and statutory laws, the right to remove all or any part of the Properties posted on the User's website or on the Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., website. Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., accepts no responsibility for checking the accuracy of property information, reports or data files submitted by the User. While Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., shall take all reasonable efforts for data backup and business continuation efforts, the User will be solely responsible for retaining back-up copies of all information, photographs and other materials it provides to Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc. Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., may add digital watermarks to certain parts of your property listing, including photographs. These digital watermarks are to protect against the copying or further distribution of your photographs without your permission.
- User agrees not to submit any property descriptions, photographs, financial information, contact information or other property specific information contained within each property listing data to Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., unless the User has received all necessary rights and authorizations, including from the photographer and/or copyright owner of any photographs, to publish and advertise the property on Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., website or if the user uses any other services provided by Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc. User will not submit a photograph if User received the photograph from a third party under the terms of a license agreement that does not allow posting of such photographs on the Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., website. Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc. may, in its sole discretion but without any obligation to remove properties that are alleged to have been submitted in violation of their user agreements. In addition, Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., may require additional documentation of compliance with this provision from Users who are alleged to have submitted properties or other information in violation of this Agreement. Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., will, in its sole discretion, terminate the accounts of, and refuse service to, any User who repeatedly or knowingly violates this Agreement. User agrees to maintain accurate contact information (specifically, a valid phone number and email address) in order to submit and maintain active property listings on the Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., website. Additionally, the User agrees to allow the property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., website or any of its additional services. The Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., shall have the sole authority to choose the manner in which any property will be searched, displayed, accessed, downloaded, copied, and otherwise used on the Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., website and shall have the right to modify the property listing in the exercise of its rights under this Agreement.
- User agrees to treat all information obtained from this Service, including listings, User contact information, historical transaction information including listings for sale or lease properties, leased and sold properties, and any information submitted by User (individually and collectively, the "Content") as proprietary to Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc.. User agrees that submitted content reserved will be maintained as confidential and shall be protected as a trade secret of Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc. Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc. does not ensure the accuracy of, endorse or recommend any content and the User uses such content at the User's own risk. User may access the active property listings and/or the Sold or Leased information solely to obtain initial information from which further research, evaluate and/or investigation may commence.
- User agrees to never use Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., for any reason other than marketing or searching for a property, without expressed written consent and permission from Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc.
- Property listings and contact information are limited to personal and internal use, and User shall not use any information obtained from this website and/or service for further distribution, publication, public display, or preparation of derivative works or facilitate any of these activities in any way. User shall not use or reproduce any content that is obtained from Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., or that is otherwise made available to from this website or service, for or in connection with any other listing service or device without the expressed written consent of Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc.
- User agrees that Cyber Property Exchange (CPREX.com), a Division of Cyber Real Estate Inc., has the right to modify this agreement and/or modify or terminate any services being offered to you with or without notice.
